Grand jury indicts Eagle Rd. robbers

Three Canton men who broke into an Eagle Rd. residence last July were among 16 indicted by the current term of the Carroll County grand jury who met in a one-day session Sept. 2.

According to Carroll County Prosecuting Attorney Donald R. Burns, Jr., the grand jury heard testimony from 20 witnesses, involving the 16 cases, all of which were returned as indictments.

Burns said indictments were returned against:
Ernest L. Reynolds, 32, of 1429 Harrisburg Rd. NE, Canton, Joseph M. Dalton, 30, of 1460 Shriver Ave. NE, Canton, and Jimmy L. Shaw, 24, of 2208 Penn Place NE, Canton, who were each indicted on one count of burglary, a 3rd degree felony; one count of theft, 5th degree felony; one count of aggravated robbery, 1st degree felony, and one count of felonious assault, 1st degree felony.

Reynolds was indicted on an additional count of aggravated robbery, 1st degree felony; one count of assault, 4th degree felony; one count of failure to comply with an order or signal of a police officer, 3rd degree felony, and one count of grand theft of a motor vehicle, 4th degree felony.

According to Prosecutor Burns, the charges were a result of an incident that began July 27 when the trio were caught removing items from an Eagle Rd. residence that they had broken into at which time Reynolds was able to flee the scene by attempting to strike Lt. Robert T. Watson with a vehicle.

A manhunt was conducted involving several local law enforcement agencies to search for Reynolds.

Burns said Reynolds was then captured later that day after another struggle with two more deputies in which he tried to remove Lt. Calvin Graham’s firearm and steal a Sheriff’s office cruiser causing physical injury to Graham.

The 13 other indictments included:
DENNIS R. McCLELLAND, 32, of 9203 SR 164, Bergholz, indicted on two counts of aggravated possession of drugs, each 5th degree felonies. It is alleged on or about July 26, McClelland possessed Percocet and Oxycontin, each Schedule II drugs and did not have a prescription for either of them. JAMES J. TOLIN, 27, of 6156 Vo Ash Dr. SW, Carrollton, indicted on one count of possession of heroin, a 5th degree felony. It is alleged that on or about Aug. 8, Tolin possessed heroin.

STAFFORD E. CUMBERLEDGE JR., 33, of 367 1/2 Park Ave., Carrollton, indicted on one count of receiving stolen property, a 5th degree felony.

It is alleged that on or about June 10, Cumberledge was found to have speakers and accessories in his possession that had been reported stolen from a Gallo Rd. resident.

REBECCA K. AQUINO, also known as, REBECCA K. HADLEY, 33, of 5948 Edgewood Circle, Dublin, indicted on one count of grand theft, a 4th degree felony. It is alleged that between Jan. 1, 2005, through June 1, 2009, Hadley stole over $62,000.00 from her employer.

BRIAN E. TOWNSEND, 23, of 511 McKinley St., Minerva, indicted on two counts of assault, each 4th degree felonies. It is alleged that on July 31, Townsend assaulted two Minerva police officers.

CAINE WYATT, 35, of 5081 Citrus Rd. NW, Lot 2, Malvern, indicted on one count of failure to comply with an order or signal of police officer, a 3rd degree felony. It is alleged that on July 10, after receiving an audible and visible signal to stop his vehicle by the Carroll County Sheriff’s Office, Wyatt failed to do so.

JOHN T. BAIR, 33, of 7102 Alliance Rd., Malvern, indicted on one count of trafficking in marihuana, a 4th degree felony. It is alleged that on April 13, Bair sold marihuana.

CHARLES R. LOTERBAUGH, 22, whose last known address was 7088 Alliance Rd., Malvern, indicted on two counts of trafficking in marihuana, each 5th degree felonies. It is alleged that during April 2009, Loterbaugh sold marihuana.

CHRISTOPHER G. ARNTZ, 20, of 9131 Willowdale, Magnolia, indicted on one count of grand theft, a 3rd degree felony. It is alleged that on Aug. 8, Arntz stole a revolver from a Magnolia resident.

STEPHEN J. RUSSELL JR., 29, of 350 Carolyn Court No. 10, Minerva, indicted on one count of aggravated burglary, a 1st degree felony, and one count of robbery, a 2nd degree felony. It is alleged that during August 18, Russell forced entrance into a Minerva residence, struck an individual and then took a cell phone as he was fleeing the scene.

CASEY L. LEWIS, 26, of 169 W. Columbia St., Alliance, indicted on one count of theft and one count of receiving stolen property, each 5th degree felonies. It is alleged that on or about June 19, Lewis stole a check from a family member.

DALE M. DEMPSEY, 25, of 1062 Delta 77th Dr., Akron, indicted on one count of forgery, a 5th degree felony. It is alleged that on August 17, Dempsey uttered a forged check at a Minerva business.

DUSTYN J. WOOD, 21, of 7990 April Rd., Salineville, indicted on two counts of corrupting another with drugs, each a 4th degree felony. It is alleged that on August 29, Wood furnished marihuana to two juveniles.

Prosecutor Burns also said that the Grand Jury inspected the Carroll County Jail and in a written report filed with the Clerk of Courts noted no violations of applicable state laws and regulations. Burns also indicated that arraignments will be held before Judge Dominick E. Olivito Jr., in the Carroll County Common Pleas Court Thursday, Sept. 10, 2009 at 8:30 a.m.
